New Use

New Use is a provision within most AFM contracts that provides that if music is recorded for one medium (say, sound recording) and is then used in a new medium (say, television, jingle or film) then the original producer must pay the musicians who recorded the music the applicable fees for recording the music for that new medium.

To make use of this provision, the New Use must occur after the filing of the original contract.

New Use is paid in addition to any synchronization or mechanical fees to be negotiated by the rights holder.

In some cases, New Use will generate a series of payments as music continues to enter new domains of use.
